Plea challenging validity of Feroz as MP quashed

The High Court (HC) on Thursday turned down a writ petition filed by a municipality mayor challenging the legality of the post of Chief Whip ASM Feroz as a member of parliament.
A two-member HC bench comprising Justice Md. Ashfaqul Islam and Justice Zafar Ahmed dismissed the writ petition. Jiaul Haque, mayor of Baufal Municipality in Patuakhali district, filed a writ petition with the HC challenging the validity of Feroz as an MP despite being as loan defaulter.
Following the writ petition, the HC on February 10, issued a rule asking the authorities concerned to explain under what authority Chief Whip ASM Feroz was holding office as the Member of Parliament.
The final hearing over the writ petition was finished on August 31. According to the information of the Credit Information Bureau of Bangladesh Bank (BB), Feroz was a loan defaulter till November 26, 2013.
However, according to the Representation of the People Order (RPO), a person has to pay off his loan seven days before submitting nomination letter to the Election Commission.
As he was a loan defaulter four days prior to submitting his nomination letter to run in the January 5, 2014 election, he was not a valid candidate to be a parliament member, according to the article 12 (m) of RPO.
