Tonu murder's fair trial not possible with obsolete criminal law: Judiciary will tumble if laws not reformed: CJ

Staff Reporter :Chief Justice Surendra Kumar Sinha on Saturday said it is not possible to hold fair trial of Comilla Victoria College student Sohagi Jahan Tonu murder case with the eighteenth-century criminal law. “We need to apply modern technology leaving behind the old mentality to investigate and hold trial of Tonu murder case as it is a modern crime,” he said while addressing a launching programme of two books written by Law Commission Member Prof Shah Alam at Nabab Nawab Ali Chowdhury Senate Bhaban of Dhaka University.The Chief Justice said presently every law remains faulty and incomplete as practice of law in the Parliament is being weakened gradually. “The lawmakers’ main weakness is ignorance of the law. A lot of discussion on laws in the Parliament took place in the past. But the situation has changed now. That is the reason why presently laws have flaws,” he said. SK Sinha said there are still some anomalies in the judiciary, but not more than five to ten per cent. For these, he said, people have to face untold sufferings and the judiciary also faces tremendous pressure. “We have to accept it and continue to work for the people in such circumstances,” the Chief Justice said.”If the laws are not reformed, the judiciary department will tumble,” he said. Referring to corruption in judiciary, the Chief Justice said corruption prevails everywhere across the country and judiciary is nothing different.”As corruption prevails everywhere across the country, judiciary is not a separate island where there is no corruption and everyone here is an angel,” he said.National Human Rights Commission Chairman Mizanur Rahman chaired the occasion.
