Hearing on lifting of case against Limon deferred again

Case against Limon filed by RAB after maiming him has not been withdrawn, even after eight months of Home Ministry’s order, as hearing on withdrawal of the case was deferred again on Wednesday. This was the seventh time that the hearing had been deferred. The new date is June 23, 2014.
The Chief Judicial Magistrate (CJM) of Jhalakathi was transferred from Jhalakathi in August 2013. But none has been posted there so far. As such, hearing could not be held as Acting CJM and Senior Judicial Magistrate Md. Arifuzzaman has no
jurisdiction to hear such appeal, explained Advocate M Alam Khan Kalam, Additional Public Prosecutor of Jhalakathi, and defense Advocate Akkas Shikdar.
Limon Hossain, a college student who used to work in a kiln to bear his educational expenses, was allegedly maimed by RAB shooting in the leg after taking to a place adjacent to his house at Jamaddarhat under Rajapur Upazila in Jhalakathi district on March 23, 2011.
Limon’s left leg was amputated from the thigh on March 27 at Dhaka National Institute for Trauma and Orthopedic Rehabilitation (NITOR) Hospital. RAB after maiming Limon filed two cases with Rajapur Police Station against the teenager and seven others the same day of shooting him. One case was under the Arms Act and another for obstruction to perform official duty, attempt to murder and injuring RAB personnel. Sub Inspector Ariful Islam, Investigation Officer, separately submitted charge sheets on April 24, 2011 and July 1, 2012 against Limon, 16, (at the time of occurrences), under Juvenile Crime Prevention Act, and against seven other accused, members of local terrorists ‘Mizan-Morshed’ gang, under different sections of penal code. As the matter created huge sensations, the home ministry on July 9, 2013 ordered to withdraw the charges only against Limon in both of the two cases lodged by RAB.
