HC for travel ban on 122 PLFSL borrowers

The High Court has imposed a travel ban upon 122 borrowers of the People’s Leasing and Financial Services Limited (PLFSL), a non-bank financial institution, which is under process of winding up.
The court asked the law enforcing agencies to remain alert and vigilant so that the 122 borrowers, who didn’t appear before the court in compliance with its earlier order, cannot leave the territory of Bangladesh till further order.
The HC bench of Justice Muhammad Khurshid Alam Sarkar passed the order on March 9 this year after hearing on a case filed by provisional liquidator of the PLFSL Md Asaduzzaman Khan. The full text of the order released on Monday.
The court also asked the provisional liquidator of the PLFSL to trace out the present addresses of the 122 borrowers as they could not be found in their recorded addresses during issuing the last summon letter of the court.
The court asked the provisional liquidator to take help from the law enforcing agencies to trace out the addresses of the borrowers. The court directed the law enforcing agencies to render all necessary assistance to the official liquidator of the PLFSL as and when he approaches them in finding out the 122 borrowers.
The High Court bench in November last year sought a list of the loan defaulters from the provisional liquidator of the PLFSL, a non-bank financial institution which is on the process of winding up.
Then the provisional liquidator of the company submitted a list of 280 borrowers before the HC bench on November 23.
After holding hearing on the list the HC on January 20 summoned 280 loan defaulters of PLFSL and directed them to appear before the court on February 23 and 25 to place their explanations on this issue. Six defaulters were added in the list later.
Complying with the court order, 164 borrowers appeared in the court on February 23, 25 and March 9 this year. But 122 borrowers didn’t appear.
In the order the HC said, it appears before this court from the report of special messenger that the persons/entities who have failed to appear in this court are not available in the addresses which are given in the schedule.
The special messenger could not communicate the order to the 122 persons/entities and since presence of the persons/entities who have failed to appear in the court are necessary for an effective and fair disposal of the matter, also read the court order.
