Bid to sell auctioned land: Fake Onil , Sunil trying to grab land by making false documents

Savar Correspondent : Two brothers Onil Chandra Shaha and Sunil Chandra Shaha of Birulia Village under Savar Police Station are allegedly trying to grab 33.74 acres auction purchased land at Dighun Mouza by making false documents and now they are trying to sell it showing their fake identity . According to documents available to this correspondent, one Moshammad Moriom Bibi , wife of Abul Kashem Howlader of village Vitakhali under Mirzaganj Police Station of then Bakerganj and now Patuakhali district purchased 33.74 acres of land at Dighun Moza in CS/ SA plot Nos 56, 68, 917 and 910 of one Vanu Chandra Shaha in auction as per Order No-21, Rule 66 of Civil Procedure Act on July 1,1953 in case No 3032K at the cost of Tk 850 , the highest price of that time . Later, she was issued certificate of sale by the competent court on December 30, 1953 and the possession of the land was handed over to the auction buyer Moriom Bibi on June 20, 1954 by the authority concern . After taking possession of the property, her only heir and son Md Habibur Rahman enjoyed the rights of the land by cultivating crops, fish and rent for over 12 years . Later, with the bad intention of grabbing land Onil Chandra Shaha and Sunil Chandra Shaha of Birulia Village under Savar Police Station falsely identified themselves as sons of late Vanu Chandra Shaha and recorded the property in favour of them in the latest City Survey . To challenge the wrong record in the City Survey, the only heir and son Md Habibur Rahman filed Civil Suit No 756/ 2016 against Onil Chandra Shaha and Sunil Chandra Shaha in the Court of Joint District Judge , Dhaka on October 26, 2016. In the meantime , the defendants of the case Onil Chandra Shaha and Sunil Chandra Shaha sought time several time through their lawyers but no written statement was submitted yet and the learned court ordered experty degree and the next dat of hearing has been fixed on February 28, 2017. By taking the advantage of long time , they are allegedly trying sell the the suit property to different persons and organisations . While talking to this correspondent , Md Habibur Rahman , the plaintiff of the case said, if they sell the land by showing false documents during pending of the suit , I will suffer huge loss and legal complication will arise again . He further said, over nine acres of land of the suit property have been acquired by the Government for the Water Development Board and Onil Chandra Shaha and Sunil Chandra Shaha claimed the compensation of the property but they did not prove the ownership to the officials of Land Acquisition Section of the Deputy Commissioner, Dhaka . It proves that they are false . On the other hand, Yousuf Ahmed Tuhin , Executive Officer (Legal Aid) of Society for the Enforcement of Land Rights (SELR) , an organisation working with the land rights said, they got complain about the forgery of this land by a section of people and they are investigating into the matter. He said, our team has already visited spot to find out the real owners of the land . In the primary investigation in the area Birulia in Savar.
