The High Court (HC) Division of the Supreme Court on Wednesday cleared the way for the trial court to revive the stalled case filed against suspended Rapid Action Battalion (RAB) officials for alleged involvement in looting Tk 2.07 crore from a shrine in Chittagong.
The HC Bench comprising Justice SM Emdadul Hoque and Justice SM Mozibur Rahman lifted the stay order rejecting the bail petition filed by the suspended RAB official Flight Lt Sheikh Mahmudul Hasan praying to the court to scrape the case proceedings.
Mohammad Idris of Talsara Darbar Sharif filed the case with the local police station against 10 members of RAB-7, two of their informants and some 15 unnamed persons on March 13, 2012 on charge of looting the money.
In the case statement, the complainant alleged that the RAB officials with the help of their cohorts entered the shrine and looted Tk 1.07 crore after breaking open steel cupboard of the Darbar Sharif in the name of search operation. The money was given by the followers of the Darbar Sharif and kept inside the cupboard, he said.
They smashed open three cupboards and took away the cash that was kept there.
Four months later, driver of the shrine Idris Ali filed a robbery case with Anwara Police Station accusing 10 RAB men and two of their informants. The others were not included in the charge sheet, as their involvement was not proved in the incident.
The RAB authorities sent the 10 accused back to their parent forces after a
departmental investigation found them guilty of robbery. Zulfiqar was posted to Army Training and Doctrine Command Unit in Mymensingh Cantonment. Later the Army carried out a departmental investigation and sacked him.
The Anwara Police Station and Dhaka Metropolitan Police (DMP) in a joint operation arrested Zulfiqar from Moghbazar in Dhaka.
The other accused are Flight Lt Sheikh Muhammad Hasan, Suberdar Abul Bashar, Captain Ohidul Hasan, Sub-Inspector Tarun Kumar Basu, Assistant Sub-Inspector Hasanuzzaman, Nayek Jahangir Hossain and Nayek Suman Chandra Dey, Lance Nayek Liton Mia, Lance Nayek Jasim Uddin, soldier Ashraf Uddin, sources Didar Ul Alam and Anwar Mia.
