Negligence to court order: Contempt of court against 6 govt officials

High Court Division of the Supreme Court of Bangladesh issued Rule Nishi upon six govt officials of Chittagong for alleged negligence towards court order in ascertaining the demarcation of Balumahal(sand lifting block ) in Karnaphuli River under Noapara Union of Raozan upazila .
The Rule Nishi issued to Secretary of LGRD Ministry , Deputy Commissioner of Chittagong, UNO of Raozan, Asstt. Commissioner of Land, Raozan and the Officer- In-Charge of Raozan thana.
The Rule Nishi was issued following the allegations of a leasee of the sand block (Block No.1) Haji Md. Alam of Mowa Enterprise .
Our Raozan correspondent said Mowa Enterprise took lease of the said sand block of 40 acres of land of Karnaphuli river under Noapara UP jurisdiction in 2016 but the leasee was resisted by a group of local influentials while lifting sand from river bed, he added. .The leasee instantly informed the concerned authority in connection and reguested them to identify the specific areas of the leased sand block, sources said. .Despite the repeated request to the local administration to identify the areas of sand lifting field , the leasee sent a legal notice to the concerned authority on October 24 last and lastly took shelter of Higher court on November 16 last.
 Following the appeal of the leasee HajiMd. Alam , High Court Division bench comprising of Justice Moazzem Hossain and Justice Badruzzaman issued Rule Nishi on six govt officials to answer it by next two weeks. Defying the higher court’s order, concerned authority again invited tenders for 98 sand lifting blocks including the Block No.1 ( previously leased) on March 1 last, leasee sources said.
Following the new tender for the said sand lifting block, the leasee Mowa Enterprise filed a writ before the higher court.
Justice Md. Ashraful Islam and Justice Ashish Ranjan Das bench sued the concerned officials of Chittagong for negligence towards court’s order earlier.In the meantime, the show cause notice already sent to the concerned officials , sources said.
While contacted, Asstt. Commissioner of Land Jonaid Kabir Sohag told this reporter that the leasee Haji Alam was requested through phone and official letter several times to take possession of the sand block but he avoided our request.
 He further said reply to the earlier rule nishi aleady submitted to higher court and the notice of writ petition also received by him.
