A writ petition was filed on Thursday with the virtual court of the High Court Division of the Supreme Court seeking its directives upon the respondents for ensuring the health services of the coronavirus infected patients by the private hospitals and clinics.
Advocate Manzill Murshid, a Supreme Court lawyer, filed the petition on behalf of a rights organization, Human Rights and Peace for Bangladesh (HRPB).
The petition sought direction upon the respondents to set up a yellow zone at entrance/gate of every private hospitals and clinics having emergency facilities for giving treatment to all the coronavirus infected patients within 48 hours and to file a compliance report within seven days by the respondents.
It also prayed direction upon the respondents to ensure supply of PPE, mask, gloves etc. items which is necessary for Doctors/Nurse/staff of the yellow zone set up by the private hospitals/clinics and to submit a report about the
activities/steps taken by the advisory committee in order to prevent pandemic corona virus in Bangladesh within seven days.
The petition also prayed to the court to issue a rule upon the respondents to show cause as to why the failure of the respondents to take appropriate steps as per sections 3, 5(2), 7 and others provisions of Infectious Diseases (Prevention and Control) Act 2018 as well as Article 32 of the Constitution of Bangladesh to protect the people from Pandemic disease of coronairus should not be declared illegal.
It also wanted to know in the rule as to why a direction should not be given upon the respondents to take all necessary steps to ensure all kinds of treatment of all patients by the private hospitals/clinics in Bangladesh during the pandemic coronavirus situation.
Chairman of the Advisory Committee of the Prevention of Infectious Disease Bangladesh, Secretary of the Ministry of Health, Additional Secretary (Hospital) of the Ministry of Health, Director General of Directorate General of Health Services and President/Secretary of Bangladesh Private Clinics and Diagnostic Owners’ Association have been made respondents in the petition.
The lawyer said that the High Court Bench of Justice Obaidul Hassan may hear the petition on next Sunday.
