Staff Reporter :
A writ petition was filed with the High Court (HC) on Sunday seeking release of Md Arman, who has been serving jail for three years whereas the real accused is at large.
Compensation has also been demanded in the writ petition as Arman was innocent. Besides, writ petitioner prayed to the court to issue a rule upon the government as to why the imprisonment of Md Arman should not be declared illegal.
Barrister Humanyun Kabir filed the writ petition on Sunday on behalf of a rights organization, Law and Life Foundation.
When the petition was mentioned, the High Court bench of Justice J B M Hassan and Justice Md Khairul Alam fixed today (Tuesday) for hearing on the petition.
On April 18, 2019, a Bengali daily published a report under the banner of ‘Another Jahlam is in jail’. The writ petition was filed annexing the report.
It was said in the report that Md Arman, a handicraftsman of Bararasi, has been serving prison for the last three years despite being innocent in a drug case filed with Pallobi Police Station of the capital city. The real accused of this case is drug dealer Shahabuddin Bihari. A court sentenced Shahabuddin 10 years in a case. But Arman is serving the sentence instead of Shahbuddin.
Arman’s family members claimed, police arrested Arman just because of similarity of their fathers’ names.
Recently another wrongly accused Jahlam was released from prison after the High Court’s intervention.
