HC rule on EC: Why ‘mashal’ poll symbol allotted to Inu’s JSD faction

The High Court on Wednesday issued a rule upon the Election Commission (EC) to explain the legality of allocating the poll symbol “mashal” (torch) to the faction of Jatiya Samajtantrik Dal (JSD) led by Information Minister Hasanul Haq Inu.
They have been directed to explain their positions in four weeks as to why the EC’s decision of allocating the symbol “mashal” (torch) to Inu-led faction of the JSD should not be declared illegal.
The HC bench headed by Justice M Enayetur Rahima and Justice Ashish Ranjan Das issued the rule upon a writ petition filed
by the other faction of JSD led by Sharif Nurul Ambia and Nazmul Haque Prodhan.
The EC allocated the electoral symbol “mashal” to the faction of JSD led by Inu on April 28. Following the EC’s decision, the other faction of JSD submitted an application to the EC to review its decision. The EC maintained its decision disposing the review application on August 10.
Sharif and Nazmul led faction filed the writ petition with the HC challenging the legality of the EC’s decision.
The HC on June 22 directed the EC to settle review petition within 30 days. As the EC could not settle the review petition, the apex court issued the rule.
JSD split into two groups centering the post of general secretary of the central committee during its council on March 12 this year.
Later, both factions announced separate committees. One of the factions is led by Hasanul Haq Inu and Shirin Akhter while the other faction is led by Mainuddin Khan Badal, Sharif Nurul Ambia and Nazmul Haque Prodhan.
Both factions also appealed to the EC for “mashal” (torch) as their polls symbol. After hearing both sides, the EC allocated the torch symbol to Inu-Shirin-led JSD on April 13.
