A Police Superintendent (SP) was discharged yesterday from a rape case lodged by one of his female colleagues after he submitted a marriage certificate in a court, saying that he has already married the complainant of the case.
Judge AM Julfikar Hayat of the Women and Children Repression Prevention Tribunal-7 of Dhaka discharged SP Moktar Hossain of the Police Bureau of Investigation (PBI) after the female Police Inspector submitted a no-objection petition.
Both the complainant and the accused were present at the tribunal on Monday and told the court that they had earlier tied the knot, settling with Tk 60 lakh as “denmohor”.
Special Public Prosecutor of the tribunal Afroza Farhana Ahmed,
however, told the media that she is yet to be informed about the development.
On March 7, the tribunal accepted rape charges against the accused in the case. The court also granted him bail as the complainant did not raise any objection against it. On December 19 last year, the duo entered into an agreement of marriage, said the case documents.
On August 12 last year, the female police Inspector filed the case against Moktar Hossain with the same tribunal, accusing him of raping her several times “promising to marry her”.
Hearing the complaint, the then judge of tribunal took the case into cognizance and recorded the complainant’s statement. The judge also directed the Officer-in-Charge of Uttara East Police Station to register the complaint as a regular case.
On January 29 this year, Investigation Officer Jasim Uddin, also an Inspector of Criminal Investigation Department, submitted a charge sheet to the Chief Metropolitan Magistrate Court of Dhaka against Moktar Hossain.
According to the case statement, the complainant was acquainted with the accused, while both were posted in Sudan in May 2019 as part of a United Nations peacekeeping mission.
The incidents of rape took place between December 2019 and November 2020.a
