SC upholds bail for Nixon Chowdhury in EC’s case

The Supreme Court on Thursday upheld a High Court order that granted anticipatory bail for eight weeks to independent lawmaker from Faridpur-4 constituency Mujibur Rahman Chowdhury, well known as Nixon Chowdhury, in a case filed by election commission.
Chamber judge of the Appellate Division Md Nuruzzaman passed the order after hearing a petition filed by the government against the High Court order.
“We are not interfering the High Court order as it is a short time anticipatory bail,” said the judge while passing the order.
Advocate Baset Majumder appeared in the court on behalf of Nixon Chowdhjury, while Assistant Attorney General M Saiful Alam represented the state.
Earlier on October 20, the High Court granted anticipatory bail for eight weeks to Nixon Chowdhury in the case.
The High Court bench of Justice Sheikh Md Zakir Hossain and Justice K M Zahid Sarwar passed the order after hearing a bail petition filed in this regard.
The HC asked Nixon Chowdhury not to influence the witnesses during the investigation of the case and not to show any kind of threat to the local administration. The court also asked him to co-operate with the investigation officer.
Dr Shahdeen Malik who appeared for Nixon in the High Court hearing said that the case statement mentioned of a call recording. But no one has the ability to record telephone conversations of others without the permission of the home ministry and such recording without the permission is a crime as per the law, added the lawyer.
Lawyers on behalf of Nixon filed the petition on October 18 this year with the High Court seeking anticipatory bail in the case.
The Election Commission filed the case with Charbhadrasan Police Station on October 15 against Nixon Chowdhury for violating the election code of conduct during the Charbhadrasan Upazila Parishad by-elections held on October 10.
