The Appellate Division of the Supreme Court yesterday summoned a joint district judge of Narayanganj to explain the reason behind his failure to dispose of a case filed in 2006.
A four-member Appellate Division bench led by Chief Justice Syed Mahmud Hossain passed the order on Wednesday. The highest court directed the sub-ordinate court judge to appear in person before it on February 13, when the apex court is scheduled to pass the next order.
The Appellate Division passed the incumbent order after hearing on an appeal of Titas Gas authorities challenging the verdict of the High Court Division.
Senior lawyer Barrister Mainul Hosein moved the case at the Appellate Division on behalf of the Titas Gas Company, while Senior advocate Kamal Ul Alam represented the writ petitioner company- Mac Papers Limited in the court and advocate Shahnaj Akhter assisted him.
Mac Papers Limited filed a case with a sub-ordinate court for declaring 12 months’ bill of Titas Gas Company illegal. On March 15, 2007, trial court rejected the case. The organization filed a case with the High Court challenging the verdict of the sub-ordinate court. Later, after final hearing , on July 4, 2008, a bench of the High Court gave the verdict asking the company to pay Tk 17 lakh every month. They were also directed to pay a regular bill of Tk 7.5 lakh per month. Besides, the sub-ordinate court was asked to dispose of the case by November 30, 2008.
Titas Gas authorities lodged a civil appeal against this verdict of the High Court. On Wednesday, hearing, the Appellate Division, during the observed uncommon delay in disposing of the case and summoned the Sub-ordinate District Judge of Narayanganj to appear before it.
