Shamarukh murder: SC scraps state plea against Humayun’s bail

There is no longer a bar on the bail of key suspect in the alleged murder of doctor Shamarukh Mahjabin, her husband Humayun Sultan Shadab.
A four-member Appellate Division bench, led by Chief Justice Surendra Kumar Sinha on Thursday scrapped a state petition against the March 2 High Court bail.
Assistant Attorney General and Advocate on Record Sadhan Kumar Banik represented the state, while M Amir Ul Islam and Monsurul Haque Chowdhury stood for the defendants.
Following the High Court bail order, the state had appealed to the Appellate Division to overturn the temporary release. Chamber Judge Justice Hasan Foez Siddique forwarded the petition to the full bench on March 4.
The bench heard the plea for the first time on Mar 9, stalled the High Court order and ordered the state to file a regular appeal before the next hearing,
Monsurul told bdnews24.com; “High Court gave bail to Humayun Sultan. The Appellate Division scrapped the state’s leave to appeal removing any legal bar on his release.”
Twenty-four year old Shamarukh was found hanging from the window grill of her bathroom at her in-law’s Dhanmondi home on November 13 last year.
She was declared dead at the Central Hospital.
She married Humayun, son of former Awami League MP from Jessore Tipu Sultan and Dr Jesmin Ara Begum, two years ago.
She was studying for FCPS at the Bangabandhu Sheikh Mujib Medical University (BSMMU) after passing the MBBS from Dhaka’s Holy Family Medical College, where her mother-in-law teaches gynaecology.
The report of her first autopsy, done at Dhaka Medical College and Hospital, had said Shamarukh committed suicide.
But her father Nurul Islam, a retired PWD engineer, rejected it saying the ex-MP and his wife ‘influenced’ the findings.
Humayun was arrested and questioned by police but his parents secured anticipatory bail from the High Court.
Shamrukh’s colleagues have been demonstrating, demanding justice for the death. Demonstrations were also held in Jessore.
