Moon Cinema Hall: SC orders to fix price of land

The Supreme Court (SC) on Sunday ordered the government to submit a report within six weeks, fixing the price of the land of Moon Cinema Hall and the installations by a engineer.
The apex court also fixed April 13 for further hearing on the matter.
A four-member bench of the Appellate Division of the Supreme Court headed by the Chief Justice Surendra Kumar Sinha passed the order after hearing a petition filed by the owners of the Moon Cinema Hall.
In the verdict on the Fifth Amendment of the Constitution, the Supreme Court directed the government to return the Moon Cinema Hall to its owners within 90 days. But the judgment of the apex court was not executed in last six years.
In the mean time, a multi-stored commercial building had been built in the place of Moon Cinema Hall. At this, the owners of the Cinema Hall filed an contempt of court petition. In the hearing, the State said there was no opportunity to return the Cinema Hall. Then the court ordered to fix the price of Moon Cinema Hall and the installations by a engineer.
Attorney General Mahbubey Alam told the reporters that the place of the Cinema Hall was donated to the Muktijoddha Kalyan Trust for a symbolic price of Tk one in 2001. Then the Kalyan Trust established a multi-stored building there. In this circumstances, the AG said, there is no scope to return the Cinema Hall, but the owners can get a compensation after fixing a price of the Cinema Hall.
The High Court (HC) in a verdict declared the Fifth Amendment of the Constitution illegal in 2005. The HC directed to return the Moon Cinema Hall within 60 days after publishing the judgment.
The Appellate Division on February 1, 2010 upheld the verdict of the HC. The government filed a petition seeking review of the judgment in March in 2011. In the review verdict, the Appellate Division granted 90 days time to return the Cinema Hall.
Though years have been passed after that verdict, the Cinema Hall has not been returned. At this, the owners of the Cinema Hall filed a contempt of court petition on January 10, 2013.
