SC defers Nizami’s review plea hearing for a week

The Supreme Court (SC) will hear next week the review petition filed by war crimes convict Jamaat Ameer Maulana Matiur Rahman Nizami against the SC’s judgement that upheld his death penalty for his wartime offences.
A three-member bench of the Appellate Division of the apex court, headed by Chief Justice SK Sinha, on Sunday deferred the hearing for a week, while hearing an adjournment petition of the Jamaat leader.
SM Shahjahan, a lawyer of Nizami, told reporters that they had prayed for
six weeks time from the SC for hearing the review petition on the ground of personal difficulties of Nizami’s principal lawyer Advocate Khandker Mahbub Hossain. But the apex court said that it would hold hearing the next week, said the lawyer.
Attorney General Mahbubey Alam represented the state while Khandker Mahbub Hossain and Barrister Najib Momen moved for Nizami. The matter was included in the Supreme Court’s cause list for Sunday.
Earlier on March 30, the prosecution filed a plea with the Appellate Division for a quick hearing on the review petition. The prosecution filed the plea with Chamber Judge Justice Mirza Hossain Haider, who later sent it to the regular bench of the Appellate Division, fixing April 3 for the hearing.
On March 29, Barrister Najib Momen, son of Nizami, submitted a 70-page review petition with the Appellate Division, praying to the apex court to acquit the Jamaat leader of all the charges on which he was found guilty. The review petition mentioned 46 grounds seeking release of the convict in the war crimes case, Barrister Najib told reporters.
On March 15, the International Crimes Tribunal (ICT) issued a death warrant for Nizami after the apex court released the full text of its verdict upholding his death penalty. The following day, the jail authorities read out the judgement to the convict.
On January 6, a four-member bench of the Appellate Division headed by the Chief Justice upheld the death sentence of the Jamaat Ameer for his crimes against humanity during the Liberation War in 1971.
On October 29 in 2014, the International Crimes Tribunal (ICT)-1 handed down the death penalty to Nizami on four charges of war crimes. The 71 year-old Jamaat leader was also awarded life imprisonment on the four other charges.
Nizami filed an appeal with the SC on November 23 in 2014 challenging the death sentence and claimed himself innocent and sought to be cleared of the charges.
