The High Court on Tuesday directed the authorities concerned of the government to provide the certified copy of the mobile court verdict within five working days after submitting application so that the convicted person could file appeal against their punishment.
Cabinet Secretary and Home Secretary have been asked to take necessary steps in implementing the HC order so that the aggrieved convicted persons could file appeal against the mobile court order, if there any.
In response to a writ petition, the HC Bench comprising Justice M Enayetur Rahim and Justice Md Mostafizur Rahman came up with the order.
One Mohiuddin, who was convicted by a mobile court on September 18, filed the petition before the HC seeking its directive over the matter as he could not file appeal against the mobile court verdict for not getting the certified copy of punishment. Executive Magistrate Sarwar Alam punished Mohiuddin to six months jail while he was conducting mobile court on September 18.
On September 25, Mohiuddin filed an application to the authorities concerned seeking the certified copy of his punishment for filing appeal against mobile court’s conviction order. But, he is yet to receive the certified copy of order. As a result, he could not file appeal against the mobile court order. Therefore, Mohiuddin filed the writ petition with the HC seeking its directive over the matter.
Advocate Monwarul Islam Uzzal appeared for Mohiuddin while Deputy Attorney General Tushar Kanti Roy represented the State during yesterday’s proceedings.
