The High Court on Thursday ordered the respondents to produce two daughters of a Japanese mother, Eriko Nakano, in the court on August 31.
Two daughters, Nakano Jasmine Malika (11) and Nakano Laila Lina (9), are currently under the custody of their father Imran Sharif and paternal aunt Amina Jebin in Dhaka. Imran Sharif and Amina Jebin have been asked to comply with the order. Officers in charge (OCs) of Gulshan and Adabor Police Stations have been asked to confirm the presence of the two children in the court.
The court at the same time imposed a ban on Imran Sharif and the two children’s leaving the country within next 30 days.
The High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order after holding hearing on a writ petition filed by Eriko Nakano seeking a directive on her husband Imran Sharif to hand over the daughters to her.
The court also issued a ruling upon the respondents to explain in four weeks as to why the respondents should not be directed to bring the minor children, who are now with Imran Sharif and Amina Jebin, in the court.
Home secretary, IGP, immigration police department, officers in charge of Adabor and Gulshan Police Stations, Imran Sharif and Amina Jebin have been asked to comply with the ruling within four weeks.
Eriko Nakano, a doctor from Tokyo in Japan, arrived in Bangladesh on July 18 this year, and filed a writ petition with the High Court on Thursday seeking a directive on her husband Imran Sharif to hand over custody of her daughters.
She submitted the petition to the HC through lawyer Mohammad Shishir Manir, saying that Imran Sharif, who now lives in Mohammadia Housing Society under Adabor Police Station in Dhaka, may leave Bangladesh with their daughters.
Eriko Nakano, in the petition, said that she and Imran Sharif got married on July 11, 2008 in Japan under Japanese law. They have three daughters Nakano Jasmine Malika (11), Nakano Laila Lina (9) and Nakano Sonia Hana (7).
Eriko on January 28 in 2021 filed a complaint with the Tokyo Family Court for getting back her children. The Tokyo Family Court on May 31 pronounced the judgment and granted custody of the children in favour of Eriko and further ordered Imran to hand over them to her.
But Imran Sharif picked up their daughters Malika and Lina from their school in Tokyo on January 21 this year, and on February 18 he left Japan for Dubai of the United Arab Emirates, taking two children with him and finally came back to Bangladesh.
In the petition, Nakano prayed to the HC to order Imran Sharif to produce the children in the court in three days to demonstrate that they have not been confined illegally. In the petition, she said Sharif took her daughters and has been harassing her by preventing her to speak with them.
