The High Court (HC) on Thursday rejected a writ petition filed for the division facilities in jail for Jamaat leader Delawar Hossain Sayedee who was sentenced to imprisonment until death on charge of crimes against humanity.
The HC bench of Justice Syed Muhammad Dastagir Husain and Justice Md Iqbal Kabir
passed the order after concluding hearing on the petition.
Division facilities include a bed, mosquito net, table, chair, newspaper and better food for a convict.
Shamim Bin Sayedee, son of the convict, filed the petition with the HC on behalf of his father on June 24. The HC bench passed the order yesterday after hearing on June 26 and 27.
Advocate Khandker Mahbub Hossain and Advocate Tanveer Ahmed Alamin took part in the hearing on behalf of Sayedee, while Attorney General Mahbubey Alam and Deputy Attorney General Amit Talukder stood for the state.
In the petition, Sayedee said that he got division facilities during trial by the International Crimes Tribunal, but after his verdict he was not getting any such benefits in prison.
Advocate Khandker Mahbub Hossain prayed to the HC to direct the jail authorities to provide him with such facilities and to send him to a specialised hospital.
Attorney General Mahbubey Alam opposed the writ petition, saying that Sayedee has no right to move such a petition to the HC as per the Constitution.
The International Crimes Tribunal-1 on February 28, 2013 sentenced Sayedee to death for killing Ibrahim Kutti and one Bisa Bali in Pirojpur during the country’s Liberation War in 1971.
But after two appeals submitted by Sayedee and the government, the Appellate Division on September 17, 2014 commuted Sayedee’s death sentence to imprisonment until death.
On May 15, 2017, the Appellate Division upheld its earlier decision rejecting two review petitions of Sayedee and the government over the verdict.
