Zia Trust case: No bar for trial against Khaleda

Appellate Division of the Supreme Court (SC) on Monday cleared the way for Zia Orphanage Trust case against BNP Chairperson Khaleda Zia filed by the Anti-Corruption Commmission (ACC) to continue in the lower court.
The apex court passed “no order” on a petition filed by the BNP Chief seeking stay order on a HC decision and case proceedings and to allow her lawyer for cross-examination of 11 prosecution witnesses.
A four-member bench of the Appellate Division headed by the Acting  
Chief Justice Md Abdul Wahhab Miah passed the “no order” after hearing on the petition.
Now, there is no legal bar on the lower court to continue trial proceedings in the case, Anti-Corruption Commission lawyer Advocate Khurshid Alam Khan told the journalists.
He also said, Khaleda Zia can file a leave to appeal petition with the Supreme Court against an order of the High Court (HC) delivered on October 22.
Advocate Zainul Abedin, Advocate A J Mohammad Ali and Barrister Badruddoza Badol took part in the hearing in the court on behalf of Khaleda Zia.
On August 8, 2011, the ACC filed the Zia Orphanage Trust case with Tejgaon Police Station, accusing four people, including Khaleda Zia, of raising funds for the trust from unknown sources abusing power.
On August 6 in 2017, Khaleda Zia filed a petition in the HC seeking to allow her lawyer for cross-examination of nine and further cross-examination of two prosecution witnesses. After hearing, the HC disposed the petition with some observations.
Later on October 24, Khaleda Zia filed a petition in the Chamber Court seeking stay on HC order and case proceedings. The Chamber Court sent the matter to the regular bench of the Appellate Division and fixed October 26 for hearing. That day the Appellate Division held hearing on the matter and fixed October 30 for passing order.
