Legal Notice served: Minister Maya’s holding office challenged

Relief and Disaster Management Minister and Awami League Dhaka City General Secretary Mofazzal Hossain Chowdhury Maya has been served a legal notice over his legitimacy as lawmaker and minister.
A Supreme Court lawyer, Yunus Ali Akond, served the legal notice on Maya on Tuesday in “public interest” for holding the offices illegally. The notice asked Maya to explain within 24 hours under what authority he has been holding the offices after the apex court annulled his acquittal in a graft case.
 “Maya has lost right to serve as a minister or lawmaker. According to Article 66(2)(D) of the Constitution, a person who has been convicted or jailed on ethical grounds cannot contest for election or even hold the post as member of the Parliament,” Akand said.
He further said that he would file a writ petition with the High Court seeking necessary directives against Maya if he does not respond to the legal notice within 24 hours.
The Supreme Court on June 14 dismissed a verdict of the HC that acquitted the Awami League leader Maya of a corruption case. Earlier on February 14, 2008, a special court sentenced Maya to 13 years imprisonment and fined him Tk five crore for amassing illegal wealth. The court also asked the authorities concerned to confiscate his property.
But the HC later acquitted Maya of the corruption charges following his appeal challenging the special court verdict.
On June 13 in 2007, the ACC filed the case against Maya with Sutrapur police station on the charge of amassing illegal wealth and concealing information about it.
