Lohagara Upazila Nirbahi Officer (UNO), Chittagong, and three police officers on Monday offered unconditional apology before the High Court (HC) for passing imprisonment order of a man who was already in custody in October last.
UNO Md Mahbub Alam, Lohagara Police Station Officer-in-Charge Md Shahjahan and Sub-Inspectors Helal Khan and Wasim appeared before the court and offered the apology in swearing affidavit.
Accepting their apology, the High Court bench of Justice Syed Muhammad Dastagir Husain and Justice Md Ataur Rahman Khan exempted them from personal appearance before this court in this connection.
The High Court, however, directed the government to transfer the OC
to any other Police Station as he was involved in sentencing process.
On October 14 in 2017, the mobile court conducted by the Upazila Nirbahi Officer sentenced Md Belal Uddin of Lohagara upazila to eight months imprisonment.
Advocate Monzill Murshid, who appeared in the court for the petitioner, said that Belal Uddin was detained on October 13 in 2017. He was sent to the jail after he had been shown arrest in a criminal case the following day.
According to a seizure list of police, two packets of ganja were recovered from Belal Uddin when he was arrested.
Later Md Belal Uddin filed a writ petition challenging the conviction and the legality of the mobile court.
Following the writ petition filed by Belal, the HC on January 14 summoned the UNO, OC Shahjahan and sub-inspectors Helal and Wasim to explain their conducts.
The HC also issued a rule asking the respondents to explain as to why the conviction sentenced by the mobile court should not be declared illegal as it was an arranged conviction and as to why the authorities should not be asked to take legal action against those who conducted the mobile court. The court also wanted to know in the rule as to why the compensation of Tk 20 lakh should not be given to the writ petitioner.
