A legal notice was yesterday served upon Law Commission Chairman and former Chief Justice ABM Khairul Haque asking him to withdraw his comments about the verdict of the Appellate Division that scrapped the 16th amendment of the Constitution within 24 hours.
Supreme Court lawyer Sultan Mahmud sent the legal notice to Khairul Haque by registered post on Sunday.
According to the notice, the incumbent Law Commission Chairman made “offensive” comments about Chief Justice and the judiciary while criticizing the verdict about the 16th Amendment of the Constitution.
In his notice, Sultan Mahmud said that Khairul Haque while briefing press on August 9 commented on the issues which were out of “Judicial norms and values”. Sultan Mahmud also mentioned in his notice, “At the briefing, you addressed the honourable Chief Justice of Bangladesh Surendra Kumar Sinha as Headmaster and other judges of the Supreme Court as students and you also told in the briefing that whether other judges are bound to listen to you (Honourable Chief Justice of Bangladesh) which shocked me a lot”.
The Supreme Court lawyer also said, Law Commission is an organisation made by the government and Justice Khairul Haque is a government servant as the Chairman of the Commission.
“You do not have any right to comment on any judgment”, Sultan Mahmud added in his legal notice. Besides, he said that legal steps would be taken if Khairul Haque does not withdraw his comments within 24 hours.
