Khaleda sued for fake birthday celebration

A court here on Tuesday summoned BNP Chairperson Khaleda Zia in a case filed against her on charge of celebrating ‘fake’ birthday on the National Mourning Day on August 15.
Dhaka Metropolitan Magistrate Md Mazharul Islam issued the order after taking cognizance of the
case filed against her. The court asked the BNP chairperson to appear in person before it on October 17.
Earlier in the day, Dhaka Union of Journalists (DUJ) former joint general secretary Gazi Jahirul Islam filed the case with the CMM court accusing Khaleda of provoking people by celebrating her false birthday on August 15.
The case was filed under penal code sections 198 and 469. According to section 198- ‘Using as true a certificate known to be false- “Whoever corruptly uses or attempts to use any such certificate as a true certificate, knowing the same to be false in any material point, shall be punished in the same manner as if he gave false evidence.”
According to section 469 ‘Forgery for purpose of harming reputation’ “Whoever commits forgery, intending that the document forged shall harm the reputation of any party, or knowing that it is likely to be used for that purpose, shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.” In his complaint, Jahirul Islam said Khaleda’s date of birth was mentioned August 5, 1946 in her latest passport while August 9, 1944 in her marriage registration and September 5, 1946, in her (unsuccessful) SSC mark sheet.
He also said Khaleda’s a biography was published in the ‘Dainik Banglar Bani’ newspaper in 1991 where her birth date was mentioned August 17, 1945. The plaintiff also said the 15th August was declared National Mourning Day in 1996 and Khaleda has started celebrating her birth day on this day by cutting cakes since then which is ridiculous. Just to undermine Bangabandhu and hurt his family she selected this date for celebrating her fake birthday which is provocative, defamatory, disturbing and against the law of the land.
Though Khaleda had long been celebrating her birthday on August 15 by cutting big cakes, she refrained from doing it this year. The party only arranged a doa and millad mahfil on the occasion.
BNP leaders said Khaleda decided not to cut any cake as the country was in a serious crisis and many flood victims were going through immense sufferings.
Khaleda was born in 1946. But, there are a lot of debates about her actual date of birth and also about her birth year.
