Jubo Dal activist Shaon’s death: Rizvi’s case appeal against police rejected

A Narayanganj court on Sunday dismissed the case filed by BNP Senior Joint-Secretary General Ruhul Kabir Rizvi in connection with the death of a Jubo Dal worker during a recent BNP-police clash in Narayanganj.
The case was filed against police officers in the court of Senior Judicial Magistrate Imran Mollah of Narayanganj Judge Court at around 11am.
Superintendent of Police (SP) of Narayanganj district Golam Mostafa Russell along with 42 policemen have been made accused in the case, said Narayanganj Court Police Inspector Asaduzzaman.
The court gave the order of rejection on afternoon.
Meanwhile, Eminent Lawyer Dr. Shahdeen Malik told The New Nation that he never heard such an action of court.
“If any one goes to court for filing any case, the court has to order for primary investigation into the allegations. It is the 100 years practice,” Dr. Shahdeen Malik said.
Ruhul Kabir Rizvi said that according to the constitution BNP has the right the hold rallies and assemble for procession.
But, he added, this “one-party state” does not want to give anyone the democratic right.
“The final example of that took place on September 1 (Thursday),” he said.
The main accused in the case, SI Mahfuzur Rahman Kanak, was reportedly seen in a photo with a Chinese rifle during the firing, BNP leaders said.
On Thursday, BNP men brought out a procession in the afternoon to celebrate the party’s founding anniversary.
The procession was intercepted by police when it reached the second rail gate area and a clash erupted.
Police claimed that the BNP did not take permission before observing the program on the street.
On Saturday, police filed a case against 71 people over the clash.
On Friday, the victim – Shawon’s elder brother Milan Prodhan filed a murder case against 5,000 unidentified people including BNP activists at Narayanganj Sadar Model Police Station.
However, the autopsy report states that Shawon was shot in the chest, but no bullet was found.
