Momin murder case: HC upholds death sentence of two accused

The High Court (HC) on Thursday upheld the death sentence awarded to two accused in the sensational Kamrul Islam Momin murder case.
Momin, 22, a student of Dhaka Commerce College, was shot dead near his
 Ibrahimpur residence in the capital city on September 13, 2005.
The two death accused are Shakhawat Hossain Jewel and Tareq alias Zia. They are absconding.
But on Wednesday, the HC abated the then Officer-in-Charge of Motijheel Police Station A K M Rafiqul Islam, who was also awarded death sentence by the lower court, from the case as he had already died.
The High Court also upheld the life term imprisonment delivered to six other accused in the case. They are Monir Howlader, Hasibul Haque Johnny, Jafar Ahmed, Sharif Uddin, Habibur Rahman Taj and Thoth Ucha Babu. Among the six, Habibur and Babu are in jail and the others are on the run.
The High Court bench of Justice Bhabani Prasad Singha and Justice Mustafa Zaman Islam pronounced the judgement after hearing the death reference of the case and the appeals filed by Habibur and Babu.
Assistant Attorney General Bashir Ahmed told the journalists that the High Court affirmed the conviction and sentences as the allegations brought against them have been proved beyond reasonable doubt.
A gang of criminals shot Momin dead on his way to college on September 13 in 2005. He was a 3rd year student of the department of Management at Dhaka Commerce College and Vice-President of pro-JSD Chhatra League, Dhaka city unit.
Momin’s father Abdur Razzak filed a case with the Kafrul Police Station against 26 accused, including the then Officer-in-Charge of Motijheel Police Station A K M Rafiqul Islam. OC Rafiqul, however, died on December 22 in 2015 in jail.
Charge sheet was submitted against nine accused on November 11 in 2008. The court framed the charge on October 5 in 2009. It was done again on January 2 in 2011. The Speedy Tribunal-4 of Dhaka delivered the judgement on July 20 in 2011. The court awarded death sentence to three accused and life imprisonment to six others.
After the lower court’s verdict, the death references came to the High Court for confirmation. In the mean time, two accused also appealed against their life imprisonment sentence. The HC declared the judgement after hearing those death references and appeals.
Deputy Attorney General Bashir Ahmed and Syeda Shabnam Mushtari took part in the hearing on behalf of the State, while Advocate Yousuf Hossen Humayun and Sheikh Baharul Islam stood for the defense. Advocated Shafiqur Rahman took part in the hearing on behalf of the two absconing death row as state appointed lawyer.
