HC summons two judges

The High Court (HC) on Monday sought a written statement from the district and sessions’ judge of Magura for refusing to hear a bail petition of an accused in a case filed Under Section 57 of the Information and Communication Technology (ICT) Act.
The two-member HC bench of Justice Md Miftah Uddin Choudhury and Justice ANM Bashir Ullah passed the order after the accused filed a bail petition.
The court also sought a written explanation from the judge of the Cyber Tribunal of Dhaka for holding hearing on the bail petition going beyond the jurisdiction.
The case was filed against Ahmed Sabuj, a resident of Mohammadpur upazila in Magura district, for
posting an anti-government status in social media site Facebook.
Later, Sabuj filed a bail petition with a magistrate court of Magura but he was denied bail.
On November 17 last, he filed another petition with the district and sessions’ court. However, the court refused to hear the petition.
Later, he filed a petition with Cyber Tribunal in the capital which it rejected.
Finally, Sabuj’s lawyer moved the HC seeking bail.
Barrister Ruhul Kuddus Kajal and Advocate Amimul Ehsan Jubayer stood for the petitioner while Deputy Attorney General Moniruzzaman Kabir argued for the state.
Moniruzzaman said according to the law, the sessions’ court must hear any petition filed challenging the order of a magistrate court before taking cognisance of any case.
However, the sessions’ judge of Magura refused to hold any hearing on the case, he said.
On the other hand, the cyber tribunal judge cannot hear any petition of a case filed under the ICT Act before taking cognisance, he added.
