HC summons Law Secretary to appear on April 26

The High Court on Wednesday summoned the Law Secretary for repeatedly refusing its earlier order to submit a compliance over an issue.
He has to appear before the court in person on April 26 this year and to explain his position for not complying with an order passed on May 23 in 2019.
The High Court bench of Justice Muhammad Khurshid Alam Sarkar passed the order after hearing a petition filed in this regard.
In the order the court said that it on May 23 in 2019 asked the Law Secretary to file an affidavit in compliance on or before August 27 in 2019 over the court query.
“Thereafter, the matter has been appearing in the cause-list on numerous occasions for submitting the compliance by the Law Secretary, but still today no compliance was filed by the Secretary,” the court said in the order.
“Supreme Court Registrar General communicated the court’s order to the Secretary well within time. From the last three years, M Moksadul Islam, Advocate, the official liquidator tried his best to obtain compliance from the Secretary but to no avail,” also read the court order.
“Previously, on several occasions, the Deputy Attorney General and the Assistant Attorney General put their best efforts to obtain the compliance from the Secretary but that also went into the vain.”
“Finally, Deputy Attorney General Md Mozammel Haque sent a written request to the Secretary on April 18 in 2022 notifying him that if he fails to comply with the court’s order dated May 23 in 2019, then, the court shall have no option but to direct the Secretary to appear before this court in person to explain his position.”
“This court has been showing its leniency for last three years in filing the compliance by the Secretary. This court now finds it proper to ask the Secretary to appear before this court in person to explain his position as to his failure to comply with the court order dated May 23 in 2019.”
Sources said the court sought a compliance report over the management of an office related to the auditor general and official trustee.
