HC stays injunction on Chandni Chawk traders’ poll

The High Court on Tuesday stayed a trial court order that issued injunction on holding the election of the executive committee of “Chandni Chawk Business Forum” which was scheduled to be held on September 24, 2019.
The High Court Bench of Justice Khizir Ahmed Choudhury passed the order after hearing a civil revision petition filed by some traders of the Chandni Chawk Market.
Attorney General Mahbubey Alam in person and Advocate A M Aminuddin appeared in the court on behalf of the revision petition while Advocate Yousuf Hossain Humayun, Advocate Khurshid Alam Khan and Barrister Sanzid Siddique stood for the civil petition.
On September 19 in 2019, Judge of the Senior Assistant Judge Court-1 of Dhaka, Begum Kaniz Tania Rupa, issued injunction on holding the election of the executive committee of “Chandni Chawk Business Forum”.
The court passed the order after hearing a civil petition filed by 20 businessmen, including Md Jabedur Rahman of Chandni Chawk Market.
The Election Commission formed for holding the Chandni Chawk Business Forum executive committee polls published the final voter list on September 4 in 2019 for holding the balloting on September 24.
Names of Md Jabedur Rahman and 19 other businessmen of the market were excluded from the voter list, said the complainants, who filed the petition seeking temporary injunction on holding the election of the executive committee of the business forum of Chandni Chawk, one of the prominent markets in the capital.
Following an appeal petition, on September 24, judge of district & sessions judge court of Dhaka upheld the order of the senior assistant judge court-1 of Dhaka.
Business Forum on September 30 filed a civil revision petition with the High Court challenging the trial courts’ order. After hearing, the High Court passed order.
