HC rules on ‘wrongly jailed’ Arman

The High Court (HC) on Tuesday issued a rule upon the government to expalin as to why they should not be directed to produce Md Arman, who has been serving jail for three years whereas the real accused is at large, in the court to ensure that he has not been illegally confined.
The HC bench of Justice J B M Hassan and Justice Md Kharul Alam passed the order after hearing on a writ petition filed seeking release of Md Arman.
At the same time, the HC directed the Metropolitan Sessions Judge of Dhaka to send all the documents of the case to it within seven days.
On April 18, 2019, a Bengali daily published a report under the banner of ‘Another Jahlam is in jail’. A rights organization, Law and Life Foundation on Sunday filed the writ petition annexing the report. The HC heard the petition yesterday.
Barrister Humanyun Kabir Pallab appeared in the court on behalf of the petition.
Barrister Pallab said, “The court also wanted to know in the rule as to why Arman’s imprisonment should not be declared illegal and as to why the authorities should not be directed to release and compensate him.”
 “Home Secretary, IGP, Superintendent of Kashimpur Central Jail and OC of Pallabi Police Station have been asked to comply with the rule within 10 days. The court fixed May 6 for further hearing on the matter,” the lawyer also said.
It was said in the report that Md Arman, a handicraftsman of Bararasi, has been serving prison for the last three years despite being innocent in a drug case filed with Pallobi Police Station of the capital city. The real accused of this case is drug dealer Shahabuddin Bihari. A court sentenced Shahabuddin 10 years in the case. But Arman is serving the sentence instead of Shahbuddin.
Arman’s family members claimed, police arrested Arman just because of similarity of their fathers’ names.
Recently another wrongly accused Jahlam was released from prison after the High Court’s intervention.
