HC embarrassed to hear plea against AG

A judge of a High Court (HC) bench on Sunday felt embarrassed to hear a petition filed challenging the legality of Advocate Mahbubey Alam holding the office of Attorney General of Bangladesh.
An HC bench of Justice Quazi Reza-Ul Hoque and Justice Mohammad Ullah refrained from hearing the petition as one of them declined to hear it, said petitioner Advocate Eunus Ali Akond, a Supreme Court lawyer.
But The bench did not disclose who had felt embarrassed and what was the reason. The bench also decided to send the petition to the chief justice.
Now after receiving the petitions, the chief justice will assign another HC bench for hearing the petition.
Additional Attorney General Murad stood for the State.
On November 10, Supreme Court lawyer Eunus Ali Akond filed the writ petition challenging the legality of Mahbubey Alam holding the AG office.
The president appointed Attorney General Mahbubey Alam under Article 64(1) of the Constitution. According to this article, the President shall appoint a person as AG who is qualified to be a SC judge, Eunus Ali Akond said in a legal notice which he issued on March 21.
The age limit of SC judge is 67 years.
Mahbubey Alam turned 67 years on February 17 this year and he cannot hold the office of attorney general any more, Eunus Ali said in the petition.
Under the constitution, there is no specific age limit for the attorney general, Eunus Ali said while replying to a question.
