DCC polls: HC clears Tabith’s candidacy

The High Court on Monday rejected a writ petition summarily that sought cancellation of BNP mayoral candidate Tabith Awal’s candidacy in Dhaka North City Corporation (DNCC) on charge of concealing wealth information in his affidavit.
The High Court bench of Justice JBM Hassan and Justice Md Khairul Alam passed the order after holding hearing on the petition filed by former judge of the appellate
division of the Supreme Court Justice AHM Shamsuddin Chowdhury Manik.
Barrister Rokanuddin Mahmud appeared in the court on behalf of Tabith Awal while advocate M Quamrul Haque Siddique stood for the petitioner.
The court said in its ruling that the petitioner annexed some papers seems relating to business of Tabith Awal with the Singapore-based NFM Energy Company, but it was not possible to verify the documents submitted to the court as the scheduled election date February 1, 2020 is leaving only 4 days.
Since there was a scope to raise this allegation after the election, it would be better for both sides to raise this in the right forum then, if anyone felt interest. Therefore, the application was rejected summarily, added the court in the ruling.
Petitioner AHM Shamsuddin Chowdhury Manik said that he would file appeal petition against the High Court order.
Justice AHM Shamsuddin Chowdhury Manik filed the petition with the High Court on Sunday.
Earlier on January 23, Justice Shamsuddin served a legal notice to the Election Commission demanding justice over concealing wealth information in the affidavit filed by Tabith Awal with the returning officer.
