Identical confession of 3 accused: Faridpur Sr Judicial Magistrate seeks unconditional apology

Faridpur’s Senior Judicial Magistrate Md Mainul Islam on Thursday apologized unconditionally to the High Court for not properly following relevant rules in recording confessional statements from three accused in a school student murder case.
Mainul Islam appeared before the HC bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman yesterday (Thursday) in line with its September 16 order and offered unconditional
apology and expressed his grief in writing. After holding hearing on the issue, the HC bench exempted the Senior Judicial Magistrate from appearing personally in this court any more in this connection.
The HC bench also granted six months’ ad-interim bail to two of the accused of the case, Azizul Sheikh and Ashraf Sheikh, for six months and fixed November 19 for further hearing on this issue, said Barrister Ruhul Quddus Kazal who appeared in the court for the accused.
On September 16, the HC bench summoned Senior Judicial Magistrate Md Mainul Islam, directing him to appear before it on October 8 and asked him to explain as to why he recorded confusing confessional statements from the three accused within a very short period and without giving them adequate time.
During the hearing, Ruhul Quddus Kazal told the HC that a school student, Antor of Nagarkanda upazila in Faridpur district, was abducted and strangled to death on June 7, 2018.
Senior Judicial Magistrate Mainul Islam recorded confessional statements from Azizul and Ashraf and another accused (name not known) within two hours only on June 28, 2018, which is impossible and a violation of relevant rules as at least three hours’ time must be given to an accused for making confessional statements to the magistrate, lawyer Kazal said.
Moreover, the three accused have made more or less similar statements, which is also illogical, Ruhul Quddus Kazal argued.
After hearing the arguments, the HC bench summoned the senior judicial magistrate for his explanation on the issue, and kept the appeal pending for hearing till October 8.
The case filed for the killing of Antor is now pending with Nari O Shishu Nirjaton Daman Tribunal of Faridpur.
