A Dhaka court on Friday placed Evaly CEO Mohammad Rassel and his wife and Chairman of the e-commerce entity Shamima Nasrin on a three-day remand each in a case filed on charge of embezzling customers’ money.
Judge of the Metropolitan Magistrate court of Dhaka, Atiqul Islam, passed the order after holding hearing on a remand petition filed by Wahidul Islam, Investigation Officer of the case and a Sub-Inspector of Gulshan Police Station.
Earlier on the day the investigation officer of the case produced Rassel and Shamima in the court around 2:00pm with a 10-day remand prayer.
The court also rejected a petition filed by the Rassel and Shamima seeking their bail and scrapping the remand prayer.
Barrister Moniruzzaman Asad, Advocate JR Khan Robin appeared in the court hearing on behalf of the Evaly officials, while Public Prosecutor Abdullah Abu represented the State.
During the hearing Abdullah Abu said, “Evaly has taken money from millions of people through advertisements. The plaintiff of the case could not receive any
product even after seven months of payment. They (Evaly) are not giving the product nor the money. Rather they are giving threat when the customers are asking for money. So they need to be placed on remand.”
On the other hand the lawyers of the Evaly officials opposed the remand prayer saying that there is no criminal allegation against them and the allegation that was stated raised from a business deal. Evaly could not supply the products to the customers in time due to pandemic situation.
The lawyers also said that they had already submitted a statement in the finance ministry by which they sought six months time to repay the money to the customers.
After hearing both the parties the court placed the Evaly officials on three-day remand. The court asked the law enforcers to follow the Supreme Court directives during the remand period, said advocate JR Khan Robin.
RAB arrested Mohammad Rassel and his wife Shamima Nasrin on Thursday in a case filed on charge of embezzling customers’ money.
A team from the elite force detained the couple from their Mohammadpur residence in the capital. They were taken to RAB headquarters and later they handed over to Gulshan police on Friday after a briefing.
A customer named Arif Baker on Thursday last filed the case against them with Gulshan Police Station for not delivering him products despite taking advance payment. In the meantime, a Dhaka court asked police to submit the investigation report of the case by October 16.
The plaintiff stated in his complaint that being impressed by Evali’s advertisement he ordered products worth Tk around 0.3 million. But no product has been delivered to him even though long time passed. Rather death threat was also given to him when he contacted for the products in the Evaly’s office, also read the complaint.
