Dilemma over custody of two kids

The High Court on Monday directed to keep the two daughters of a Japanese mother and a Bangladeshi father for a better environment in the Victim Support Center of the Dhaka Metropolitan Police in Tejgaon till August 31 this year.
During this time, Japanese mothers will be able to spend time with their children every day from 7.00 am to 1.00 pm and Bangladeshi father from 3.00 pm to 8.00 pm.
The police have been asked to produce the children in the High Court on August 31. The court will hold further hearing on that day and pass order.
However, the court asked the lawyers of both the parties to play a role in resolving the issue by this time. In the final stage of the order the court told the lawyers, “If you want to continue a legal battle, you can go a long way. But the ultimate loser will be two children in this process. If you think that you need someone from a third party then I will try to help. I hope on the next date you will resolve the solution and I will only listen.”
The High Court Bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order after holding hearing on an arising situation in the aftermath of the rescued two children on Sunday evening by the Criminal Investigation Department (CID).
The state counsel has been asked to communicate the court order to the Criminal Investigation Department verbally.
Following a writ petition filed by Japanese mother Eriko Nakano, the same High Court Bench on August 19 this year ordered the respondents to produce two daughters in the court on August 31.
Two daughters, Nakano Jasmine Malika (11) and Nakano Laila Lina (9), were under the custody of their father Imran Sharif and paternal aunt Amina Jebin in Dhaka.
Imran Sharif and Amina Jebin had been asked to comply with the order. Officers in-charge (OCs) of Gulshan and Adabor Police Stations were asked to confirm the production of the two children in the court.
The court at the same time imposed a travel ban on Imran Sharif and the two children for 30 days.
The Criminal Investigation Department on Sunday last rescued two daughters from the custody of their father who brought them to Bangladesh from Tokyo without seeking permission from the mother.
Then on Monday the lawyers of the both parties brought the matter of rescuing them to the attention of the court. After hearing both the parties, the court passed order.
Eriko Nakano, a doctor from Tokyo in Japan, arrived in Bangladesh on July 18 this year, and filed a writ petition with the High Court on August 19 seeking a directive on her husband Imran Sharif to get custody of her daughters.
Eriko Nakano, in the petition, said that she and Sharif got married on July 11, 2008 in Japan under Japanese law. They have three daughters Nakano Jasmine Malika (11), Nakano Laila Lina (9) and Nakano Sonia Hana (7).
Lawyers Fawzia Karim Feroze appeared in the court hearing for Imran Sharif, while Mohammad Shishir Manir appeared for Eriko Nakano.
