Manzur murder case: Court accepts charge-sheet given by CID accusing 3

A Dhaka court yesterday accepted the supplementary charge sheet (CS) submitted by the Criminal Investigation Department (CID) against three accused in the Major Gen Abul Manzur murder case.
The three accused in the supplementary charge sheet are- Lieutenant Colonel (retired) Mostafa Kamaluddin Bhuiyan, Lieutenant Colonel (retired) Shamsur Rahman Shams and Major (retired) Kazi Emdadul Haque.
The court exempted Jatiya Party’s late Chairman HM Ershad and DGFI’s former Chief Major General (retired) Abdul Latif from the charge sheet as they already died.
Judge Dilara Alo Chandana of the First Additional District and Sessions Judge’s Court of Dhaka accepted the charge sheet after scrutinizing the case dockets and other relevant documents of the case. Then the court fixed April 6 for next hearing in the case.
On January 12, Md Kutubur Rahman, a Special Superintendent of Police at CID and the Investigation Officer of the case, submitted the supplementary charge sheet to the court.
In the charge sheet, the IO mentioned he had contacted Manzur’s wife and children, who lived abroad, but they refused to give statements to the investigators and in the trial court. He further said he did not find any flaw in the previous investigation.
On February 27, 2014, the trial court ordered further investigation in the murder case after Special Public Prosecutor Asaduzzaman Khan Rochi submitted a petition in this regard while placing the closing arguments.
“While scrutinising the charge sheet, I found some flaws and incompleteness in the probe…. Although it is a sensational case, names of some key witnesses have been dropped,” the prosecutor had told the court.
Major General Manzur was killed at Chattogram Cantonment on June 1, 1981, just two days after the assassination of the then President Ziaur Rahman.
A total of 26 judges have heard the murder case since it was filed on August 28, 1995. The judges were either promoted or transferred to other districts.
The case was filed 14 years after the murder on February 28, 1995. Manzur’s elder brother Barrister Abul Mansur Ahmed filed the case with Panchlais Police Station of Chattogram.
Later, on July 15 of the same year, charge sheet was submitted to the court against 5 including HM Ershad. The then ASP Abdul Kahar Akand submitted the charge sheet.
Of the 49 witnesses 28 testified, and in 2014, the case was kept for verdict. But, then the prosecution wanted further investigation while the court acceded to the appeal. The Investigation Officer sought time on different occasions. After six years IO CID Police Super submitted the charge sheet.
