Constitutional court cannot be closed

Chief Justice Syed Mahumud Hossain on Sunday said that a constitutional court cannot be completely closed. The constitutional court of India has never closed even in the coronavirus pandemic, he also said.
The Chief Justice made the remarks when senior lawyers wanted to know from the court whether the trial proceedings in the Appellate Division of the Supreme Court would continue if the lockdown has been imposed due to new wave of the coronavirus.
A decision on conducting trial activities during the lockdown period would be taken on Sunday, said the chief justice when he was holding hearing in the morning. Senior lawyers Barrister M Amir ul Islam, Probir Neogi and others were connected through virtual process with the Appellate Division.
In order to continue the trial activities even in the coronavirus pandemic situation, President Md Abdul Hamid on May 9 in 2020 approved the ordinance on the use of information technology by courts for holding trials, hearings and taking digital evidence using technology and virtual appearances of parties and lawyers.
Later the legislative and parliamentary affairs division of the ministry of law issued a gazette notification in this regard on the same day. After issuing the gazette, the Supreme Court had started virtual operation of the trial activities since May 10.
The government has again imposed a one-week lockdown in the country in the face of new surge of the Covid-19 virus infection which will come into effect from today (Monday). In this circumstance the Supreme Court authority is also thinking about new schedule of their daily activities.
