Direction of HM: Case for laming JCD leader withdrawn in Barisal

A Barisal court on Tuesday accepted the direction of Home Ministry for withdrawing a case lodged for laming a leader of Jatiyatabadi Chhatra Dal, student front of Bangladesh Nationalist Party.
The accused of the case never appeared before the court and trial of the case was stayed for long periods in two-times in last 12-year.
Mohammad Abu Sayeed Molla, assistant secretary of home ministry, sending a letter to concerned authorities on October 12, 2009 informed that state decided not to trial the case (nolle prosequi). So the district public prosecutor asked to give opinion about the decision under section 494 of criminal procedure act 1898.
Advocate Monsur Uddin Ahmed, AL Leader and special public prosecutor of the court for preventing crimes against public safety on May 6, 2014 expressed that the case was politically motivated and should be withdrawn.
Then the court on May 14, 2014 summoned complainant of the case to appear before the court on July 14, 2014 to give his opinion about withdrawal of the case.
Advocate Masudul Huq Khan, on behalf of the appeared complainant of the case appearing before the court with the complainant and victim, opposed the withdrawal suggestion of home ministry and demanded free fair trial of the case to punish the criminal attackers.
However Advocate Giasuddin Kabul, AL leader and district public prosecutor and Advocate Monsur Uddin Ahmed, AL Leader and special public prosecutor of the court, said the state did not want to trial the case as it was lodged by political motivation.
Md. Ali Haider, judge of the court for preventing crimes against public safety, after hearing from both sides on Tuesday accepting the suggestion of the home ministry and opinion of the prosecution ordered to dismiss the case, said special PP of the court.
After order of acceptance for withdrawal of case , the victimised city JCD joint convener and probationary advocate at Barisal court Tarikul Islam Shahin, said he now became afraid about life after losing leg as the court accepted the suggestion of home ministry and ruling AL-led prosecution to withdraw case against attackers.
He also vowed to appeal before higher court demanding speedy fair trial and punishment of the attackers for laming him for life.
The victim sources said Kaium Hossain Milton, one of the top terrors in the city and expelled city JCD leader riding on microbus with his associates attacked Shahin at about 2:00 AM June 25, 2001 near B M College campus while he went out of home in searching of an electrician to repair his table fan.
The attackers opened fire on Shahin and looting his valuables left the place.
Shahin was brought to Barisal Sher E Bangla Medical College Hospital and later to Dhaka Pongu Hospital and his left leg was amputated from above the knee to save life.
Luthfar Rahman Haoladar, a school teacher and father of Shahin, as complainant lodged a case under sections 4,5,10 of public safety act and sections 326 and 307 of penal code on August 8, 2001 against the top terrorist Kaium Hossain Milton and his 8 terrorist associates for attacking and laming his son Shahin.
