The Appellate Division of the Supreme Court on Tuesday granted bail to a murder case accused who had been serving in the condemned cell in a jail even after being acquitted by the High Court.
A four member Bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain passed the order after holding hearing on a bail petition filed by the accused in the case.
Barrister SM Masud Hossain Dolon appeared in the court on behalf of the bail seeker, while Deputy Attorney General Biswajit Debnath represented the State.
According to the case documents, six people were hacked to death at a house in the city’s Pallabi area on October 13, 2006.
The deceased were identified as Khadiza, 15, Anna, 14, Manir, 12, Bakshi, Rizia, 42, and her son Tofel, 17.
Later, Sirajul Haque, owner of the house, filed a case in this connection the following day.
The Speedy Trial Tribunal Court-2 of Dhaka awarded death penalty to four people -Masum Matabbar, Zakir Hossain, Kamruzzaman Kamrul and Mohammad Azim — in the case on October 26, 2008.
Following the death references and appeal petitions of the case the HC on April 27 in 2014 acquitted one accused, Mohammad Azim, and confirmed the death penalty of three other convicts.
Later the Appellate Division stayed the HC verdict. That is why the acquitted person could not get released.
In the meantime Mohamamd Azim filed a bail petition with the Appellate Division seeking bail in the case. Upon hearing, the apex court on Tuesday granted his bail.
Barrister SM Masud Hossain Dolon said Mohammad Azim was the no 1 accused in the FIR and he was serving in the condemned cell in the jail after being convicted by the trail court. The lawyer claimed that his client was not involved in the murder.
