The High Court (HC) on Sunday fixed today (Monday) to pass order on a writ petition filed for Division in the jail and medical treatment for Barrister Mainul Hosein who was sent to the prison in a defamation case sued in Rangpur.
The HC Bench of Justice Sheikh Hassan Arif and Justice Razik-Al- Jalil set the date after concluding the hearing on the petition filed for Division and medical treatment.
Saju Hosein, wife of Barrister Mainul Hosein, filed the writ petition with the Bench seeking division and medical treatment for Barrister Mainul.
Dr Kamal Hossain and Advocate Khandker Mahbub Hossain appeared for Barrister Mainul Hosein, while Attorney General Mahbubey Alam stood for the State.
Supreme Court Bar Association President Advocate Zainul Abedin and Advocate Masud Rana were also in the court during the hearing.
During the hearing, Dr Kamal said, “Barrister Mainul Hosein is a former Member of the Parliament and Adviser to the Caretaker Government which is equivalent to Minister. He is also the former President of the Supreme Court Bar Association (SCBA). As per jail code, he is eligible to get the division.”
Attorney General Mahbubey Alam said, “The High Court is not the proper place to seek the Division. The petitioner has to go to the trial court for it and the trial court will decide whether Division will be given or not.”Then Advocate Khandker Mahbub Hossain said, “We prayed to the trial court for the division but the court did not pass any order after the hearing. So, we have come to the High Court and the HC has the jurisdiction to pass an order on the matter. To get division in jail is Barrister Mainul’s fundamental right.”
A woman, Mili Maya Begum, on October 22, filed the defamation case in the Chief Metropolitan Magistrate Court of Rangpur against Mainul Hosein on charge of passing ‘malicious comment’ about women on a television talk show. Judge Arifa Yasmin Mukta issued the arrest warrant against him after taking the charge into cognizance.
The same day, a team of Detective Branch (DB) of police detained Barrister Mainul Hosein in the case.
The following day Additional Chief Metropolitan Magistrate of Dhaka Md Kaisarul Islam sent him to jail rejecting his bail plea after hearing.
But the filing of cases is continuing and a total of 18 cases have been filed so far in different parts of the country against Barrister Mainul in the same offence.
