An advocate of the Supreme Court on Sunday filed a writ petition with the High Court Division of the Supreme Court challenging the legality of the government decision to deduct five marks from total marks of the candidates seeking admission in MBBS class.
Advocate Eunus Ali Akond submitted the petition stating that the government’s decision to deduct five marks is discriminatory, illegal and contradictory to national education policy. He also mentioned in his petition that the decision violated the constitutional provision of equality and equal opportunity of the candidates.
As per the Constitution, nobody is to be subjected to discrimination, but the government’s decision to deduct the five marks has discriminated the second time admission seekers, he said. The petition also said the Constitution of Bangladesh granted rights to the people to get equal opportunity.
Eunus Ali Akond prayed to the High Court to stay the decision and also to issue a rule asking the respondents to explain as to why the decision should not be declared illegal.
The Health Secretary, Director General of the Directorate of Health Services, its Director (public health), Chairman of Bangladesh Medical and Dental Council and Vice- Chancellor of Dhaka University have been made respondents to the rule.
Advocat Eunus Ali Akond told newsmen that the High Court bench of Justice M Enayetur Rahim and Justice Md Jahangir Hossain may hear the petition on Monday.
