Writ filed seeking directives on govt for EC reconstitution

A writ petition has been filed with the High Court (HC) seeking directives on the government to formulate a law for reconstituting the Election Commission.
Advocate Eunus Ali Akond, a Supreme Court Lawyer, filed the petition yesterday with the HC.
Eunus Ali told the reporters that Chief Election Commissioner
and other Election Commissioners will be appointed by the President as per the provisions incorporated in the Constitution.
Article 118 (1) of our Constitution said, ‘There shall be an Election Commission for Bangladesh consisting of the Chief Election Commissioner and not more than four Election Commissioners and the appointment of the Chief Election Commissioner and other Election Commissioners (if any) shall, subject to the provisions of any law made in that behalf, be made by the President.’
But no such law has been legislated in four and half decades in this regard. That is why I filed the writ petition seeking HC directives, added the lawyer.
In the petition, Eunus Ali told to the court to issue a rule asking the government to explain as to why they should not be directed to formulate a law for reforming the EC.
Cabinet Secretary, Law Secretary, Chief Election Commissioner and Election Commission have been made respondents in the writ petition.
HC may hold hearing on the petition next week, said the lawyer.
