A writ before the High Court against appointment of a private berth operator for newly- constructed New Mooring Container Terminal(NCT) of Chittagong Port was filed recently.
M/s. Container & Terminal Services Ltd filed the writ challenging the appointment of a private berth operator-Saif Power Tec .
Following the writ so filed , the high court bench comprising Justice Miftauddin Chowdhury and Justice Ezharul Hoque Akhand issued Rule Nishi to Chittagong Port on Thursday to reply within two weeks why the appointment of Saif Power will not be declared illegal.
In the meantime Saif Power Tec has been appointed as berth operator for berth No.2,3,4 & 5
Legal Advisor of Container & Terminal Service Ltd Barrister ABM Hamidul Misbah said they filed writ against the appointment of Saif Power Tec duly approved by the Ministry of Shipping instead of Procurement Committee of the Cabinet Ministry . Ministry of Shipping approved the appointment of Saif Power Tec on June 23 and September 21 last. He further said the order of the ministry in connection violates the Public Procurement Act and Public Procurement Rules .
Mentionable that it is necessary to obtain permission from Procurement committee of the cabinet ministry in case of tender value is more than Tk.50 crores , legal counsel said.
Legal counsel in a press release issued to different news agencies and media that M/s.Container and Terminal services Ltd is owned by the ruling party legislator Saber Hossain Chowdhury. Advocate AJ Mohammad Ali appeared in the writing petition hearing duly assisted by Barrister Hamidul Misbah.
Meanwhile, a hearing before the Supreme court appellate division against Saif Power appointment duly filed by Barrister Redwan Ahmed is scheduled on November 5 next.
On the other hand , the fullfledged operation of the NCT terminal under the management of Saif Power Tec is expected to be inaugurated today by the Minister of Shipping Md. Shahjahan Khan MP today evening , a CPA sources said.
After long bureaucratic complications , Saif Power Tec has been entrusted with the operation of berth No.2,3,4 & 5 of New Morring container terminal of Chittagong Port.
Port sources said the handling capacity of the NCT targeted 13 lakh TEUs containers annually. After full-fledged operation of the NCT, the handling capacity of the Chittagong port will be double than the existing .
