Violation of oath: Writ filed against holding posts of 2 ministers

Supreme Court lawyer Advocate Younus Ali Akanda on Monday filed a writ petition challenging the legality of holding posts of Food Minister Quamrul Islam and Liberation War Affairs Minister AKM Mozammel Haque as they have violated their oath.
Advocate Akanda filed the petition with the
High Court seeking directives to explain under what authority the two Ministers have been holding the posts of Minister as they violated their oath.
He submitted the petition saying that the SC in a judgment observed that the two ministers have violated their roles at their offices by questioning the authority of the judiciary.
According to the Public Servants (dismissal on conviction) Ordinance-1985, if the government servants are fined with Tk 1,000 or more he or she will be dismissed from the services, said Advocate Akanda.
The SC fined the two Ministers Tk 50,000 each for committing Contempt of Court and therefore they cannot hold the office of the Ministers. In default, they have to serve seven days in jail.
 “Hearing on the petition might be held at a bench of Justice Moinul Islam Chowdhury on Tuesday,” said the petitioner.
Earlier on September 1, the SC published it full text of the verdict convicting the two Ministers in Contempt of Court.
The judgment said, “They have acted in violation of law and are in breach of their oath of office to preserve, protect and defend the Constitution.”
According to the Constitutional provision, by taking oath, a Minister enters his office to preserve, protect and defend the Constitution.
On Saturday, Advocate Akanda sent two separate legal notices to Food Minister Quamrul Islam and Liberation War Affairs Minister AKM Mozammel Haque seeking their explanations in 24 hours in this regard.
