The High Court on Sunday issued a rule asking the respondents to explain in four weeks as to why the government steps in refraining the 27 candidates of 37th BCS examination from joining their respective posts even after the final recommendation of the Public Service Commission (PSC) should not be declared illegal.
In the rule, the High Court also wanted to know
as to why the government should not be directed to appoint those 27 candidates who have been recommended by the PSC following the full procedure.
Public Administration Secretary, Finance Secretary and Chairman of the Public Service Commission have been asked to comply with the rules within four weeks.
The High Court bench of Justice Md Ashfaqul Islam and Justice Mohammad Ali passed the order after holding a virtual hearing on a writ petition filed in this regard.
Advocate Siddiq Ullah Miah took part in the hearing for the BCS candidates, while Deputy Attorney General Debashish Battacharya and Assistant Attorney General Nasim Islam Razu represented the state.
Mr Siddiq Ullah Miah said that his clients passed the 37th BCS examination and Bangladesh Public Service Commission (PSC) had recommended the government for their appointment. But the authorities concerned did not give them appointment nor any explanation as to why they were not recruited, he said.
The lawyer said that the government’s decision to refrain them from joining their posts is clear violation of the Constitution.
The candidates filed a writ petition with the High Court recently challenging the government steps to refrain them from joining their posts. After hearing the court issued rule over the petition.
Naimur Rahma, Imran Hassan, Mehrab Hossain, Benzir Iqbal, Md Rubaiyat Ferdous and Md Hassanur Rahman, among others, filed the petition on August 12 this year.
