Two daughters who came from Japan will now stay with their parents for 15 days instead of Victim Support Center of the Dhaka Metropolitan Police in Tejgaon.
The High Court Bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order after holding hearing from the parties and also considering the highest welfare of the two kids.
In the order, the court also said, “For the time being, everyone (parents) including the children will stay at Gulshan’s house. The Deputy Director of the Department of Social Services will oversee the matter. The Dhaka Metropolitan Police Commissioner and CID will ensure the security.”
The authorities of the Tejgaon Victim Support Centre have been asked to take the children to the new home.
During the Tuesday’s hearing, lawyer of the kids’ father proposed to keep the children in a rented house instead of Victim Support Centre. The house is in Gulshan 1. Both the parties will bear the rent of the house equally. The court has fixed September 16 for further hearing on the issue.
On August 19, Japanese woman Eriko Nakano filed a writ petition with the High Court seeking the custody of her two daughters, aged 10 and 11, from her husband Imran Sharif, a US citizen of Bangladeshi origin.
Following the writ petition the same High Court Bench on August 19 ordered the respondents to produce two daughters in the court on August 31.
Two daughters, Nakano Jasmine Malika (11) and Nakano Laila Lina (9), were under the custody of their father Imran Sharif and Amina Jebin, sister of Imran Sharif, in Dhaka.
Imran Sharif and Amina Jebin had been asked to comply with the order. Officers in-charge (OCs) of Gulshan and Adabor Police Stations were asked to confirm the production of the two children in the court.
But the Criminal Investigation Department on August 22 took the two daughters in their custody from their father’s custody. In the imazing situation the High Court on August 23 sent the kids in the victim support centre.
Following the High Court’s earlier decision the victim support centre produced the kids in the court on Tuesday. Kids’ father and mother also came to the court. The court heard the kids in its private chamber. After holding hearing on the parties, the court passed order.
Eriko Nakano, in the petition, said that she and Sharif got married on July 11, 2008 in Japan under Japanese law. They have three daughters Nakano Jasmine Malika (11), Nakano Laila Lina (9) and Nakano Sonia Hana (7).
Lawyers Fawzia Karim Feroze appeared in the court hearing for Imran Sharif, while Mohammad Shishir Manir appeared for Eriko Nakano.
