Eminent lawyers and retired army officials on Wednesday said that trial of Rab personnel in army court in the abduction and seven murder case in Narayanganj may not pose any problem in getting proper trial.But they should be tried under civil law , in case of involvement of the civilians in the particular case for uniformity and court proceedings, they added. Dr Shahdeen Malik, said, if Rab personnel are found involved in a crime of abduction or murder, they can be tried in both army and district court. If others involved are not army personnel, in that case, they should face the trial at district court, he added.If civilians are found involved in the particular case, both the accused should be tried in the same court to avoid complexity and smooth running of the case, he said. “If any member of armed forces is found involved in a serious offence like murder, he may be tried in a civil court or in a military court for the same offence depending on environment and circumstances of the offence,” Major General (retd) Syed Mohammad Ibrahim told The New Nation yesterday. In this particular case, he said, the fact that the officials have been given pre-mature or compulsory retirement, which is not a hindrance at all for their trial in any appropriate court.”Rab officials have been politically influenced as the name of an influential minister is being repeatedly raised in the media,” he said. When asked, he said, the reputation of Rab, has suffered serious damage, which needs to be reorganized.
