Kader Siddique's writ rejected: Tangail-4 by-polls now any day

Voting in the Tangail-4 constituency now can be held any day, as the High Court has disposed of the rule about cancellation of the nomination of the Krishak Sramik Janata League President Abdul Kader Siddique.
The HC on Thursday rejected the writ petition filed by Kader Siddique, challenging the legality of the EC’s decision that had cancelled his nomination. The court also directed the EC to proceed for holding the postponed Tangail-4 by-polls in accordance with law.
The HC bench of Justice Md Ashfaqul Islam and Justice Zafar Ahmed passed the order. Barrister Mohammad Easin Khan,
counsel for the EC, said that with this order the EC could now start election proceedings for holding the Tangail-4 by-polls.
The EC on September 16 last announced the schedule fixing November 10 for the by-polls to the constituency that fell vacant upon resignation of Awami League MP Abdul Latif Siddique, who is also elder brother of Kader Siddique. The EC fixed October 11 as last date for nomination submission.
The returning officer cancelled Kader Siddique’s nomination in allegation of loan default charges. Kader Siddique appealed with the EC against the decision, but the commission rejected his plea. Later, he filed the writ petition with the HC.
Following the writ petition, the HC on October 21 directed the EC to accept Kader Siddique’s candidacy and also asked it and the government to explain why cancellation of the nomination should not be declared illegal.
Later, the government filed an appeal petition against the HC order. Following the petition, the Appellate Division of Supreme Court on October 27 stayed the Tangail-4 by-polls until November 2.
Later, the apex court extended its stay order until the HC disposed of the rule and also asked the HC to dispose of it by January 31 this year.
