The High Court on Tuesday refused to grant bail to Khandaker Enamul Basir, suspended director of the Anti-Corruption Commission (ACC), in a case filed over the transaction of Tk 40 lakh as bribe.
Then his lawyer took back the bail petition.
The High Court Bench of Justice Farid Ahmed and Justice A S M Abdul Mobin heard the petition and didn’t agree to grant him bail or to issue a rule in this regard. But, now Basir has the opportunity to submit the petition in another HC Bench.
Advocate M M Jamal Hossain, a lawyer for Enamul, said they would submit the petition in another HC Bench soon.
Advocate Khurshid Alam Khan, who appeared in the court on behalf of ACC, said, “Enamul Basir have damaged the image of the ACC by taking bribe from DIG Mizanur Rahman. He cannot get bail.”
Barrister Ruhul Quddus Kazal, another lawyer for Enamul Basir, said, “Enamul Basir is a victim of circumstances and sick. So he can get bail,” he added.
On September 1, 2019 Khandaker Enamul Basir filed bail petition with the High Court in the case filed over the transaction of Tk 4.0 million as bribe.
Earlier on July 23, a Special Court of Dhaka rejected his bail petition and then he filed bail petition with the HC through his lawyer.
Enamul Basir, temporarily suspended by the Commission earlier, was arrested by an ACC team led by its Director Sheikh Md Fanafillah from the city’s Darussalam area on July 22.
ACC produced Enamul Basir to the Senior Special Judge’s Court in Dhaka where Judge K M Emrul Kayesh rejected his appeal for bail and ordered to send him to jail.
The ACC official was accused in a case for receiving bribe of Tk 4.0 million from suspended Deputy Inspector General (DIG) of Bangladesh Police Mizanur Rahman.
Earlier on July 16, Md Fanafillah filed the case against the two government officials with the ACC’s Dhaka District Coordination Office-1.
