The High Court on Tuesday cleared the way for students under 11 to apply for admission in Class Six in government high schools across the country.
In response to a writ petition, the court stayed the effectiveness of a government circular that carried a condition that students under 11 cannot apply for admission to Class Six in public high schools.
It also issued a rule asking the government to explain in four weeks as to why the circular should not be declared illegal. The stay order will continue till disposal of the rule.
At the same time, the HC directed the authorities concerned of the government to extend the time for submitting applications for admission through online for seven working days, as many students could not submit the applications due to internet and server problems.
The HC Bench of Justice JBM Hassan and Justice Md Khairul Alam came up with the order following a writ petition filed by Mohammad Mijanur Rahman, guardian of a student named Ayesha Khanom, seeking necessary directives on this issue.
Ayesha Khanom’s application was not accepted for admission as her age was below 11 years.
Petitioner’s lawyer Manjur Elahi Parag told the reporters that the government issued a circular recently giving time from December 15 to 27 to apply for the admission to class six in the government high schools. Following the circular Mijanur Rahman tried to apply for his daughter, but failed as the software didn’t accept the application due to applicant’s age was below 11 years.
In 2017 the Education Ministry issued a circular saying that the students must be six plus for the admission in class one. As per the calculation the age of admission in Class Six had been fixed 11 plus in the online software. But the applicant was born in July 30 in 2011 and her age was below 11 years, added the lawyer.
In this circumstance Mijanur Rahman filed the writ petition with the High Court.
